Terms of Service

These Terms of Service ("Terms") form a binding agreement between Work App Ltd, a company registered in England and Wales ("Work App", "we", "us"), and the organisation that subscribes to the Service ("Customer", "you"). By creating an account, inviting users, or using the Service you agree to these Terms.
1. The Service
Work App is a software-as-a-service platform for field operations, including jobs, scheduling, timesheets, materials, commissioning, snagging, reporting and document generation. We provide the Service on a subscription basis as described on workappltd.com/pricing.
2. Accounts and users
- You are responsible for all activity under your organisation account.
- You must keep credentials confidential and notify us promptly of any unauthorised access.
- You will only invite users who are your employees or authorised contractors.
- Each user must be a real, identifiable person — no shared logins.
3. Free trial
New organisations may receive a 14-day free trial. No payment card is required to start. At the end of the trial, access is suspended unless you select a paid plan. We may modify or end trial offers at any time.
4. Fees and billing
- Subscription fees are charged monthly or annually in advance per the plan you select.
- All fees are in GBP and exclude VAT unless stated.
- Plans include a user seat limit; exceeding it requires upgrading to a higher plan.
- Fees are non-refundable except where required by law.
- We may change pricing on 30 days' written notice, effective at your next renewal.
- Late payment may result in suspension of the Service.
5. Customer data
You retain all rights to the data you and your users upload ("Customer Data"). You grant us a limited licence to host, process and display Customer Data solely to provide and improve the Service. You are responsible for the accuracy and lawfulness of Customer Data, including obtaining any necessary consents from your staff and your end customers (e.g. for photos, GPS, signatures).
6. Acceptable use
You agree not to: (a) reverse engineer, copy, or resell the Service; (b) use it to send unsolicited communications or store unlawful content; (c) attempt to access another customer's data; (d) probe, scan or test the vulnerability of the Service without our prior written consent; (e) use it in breach of applicable law.
7. Intellectual property
The Service, including all software, design, documentation and trademarks, is and remains the property of Work App Ltd and its licensors. Nothing in these Terms transfers ownership of the Service to you.
8. Confidentiality
Each party will protect the other's confidential information with at least the same care it uses for its own, and only use it to perform under these Terms.
9. Service levels and support
We aim for high availability but do not guarantee uninterrupted access. Planned maintenance windows will be communicated in advance where reasonably practicable. Email support is provided on all paid plans; response times depend on plan tier.
10. Data processing and security
Where we process personal data on your behalf, we act as your data processor. Our processing terms are set out in our Privacy Policy and in our Data Processing Addendum, available on request. We implement appropriate technical and organisational measures including encryption in transit and at rest, role-based access control and row-level security.
11. Suspension and termination
- Either party may terminate a subscription at the end of the current billing period.
- We may suspend or terminate immediately for material breach, non-payment, or unlawful use.
- On termination, you may export your data for 30 days, after which it will be deleted.
12. Warranties and disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose and non-infringement.
13. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or loss of profits, revenue, data or goodwill. Our total aggregate liability under these Terms will not exceed the fees you paid us in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
14. Indemnity
You will indemnify Work App against claims arising from your Customer Data or your breach of these Terms.
15. Changes to the Terms
We may update these Terms from time to time. Material changes will be notified by email or in-app at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
16. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising under or in connection with them.
